Sharing Representative Agreement

Terminology:

"Promoter" – means You.

"Shared Customer" or "Customer" – means a person or business that purchased the 7 Tool Package or additional Direct Services as a direct result of your sharing activities.

 "Flat Rate" – means the predetermined commission to be paid to the Promoter.

"Bonus" – means a fixed percentage of additional commission made to the Promoter, on the purchase of any Direct Service made by the Shared Customer.

"Direct Services" – means any products or services offered by TapTheLINK that are not purchased from a third party or outsourced.

"First Order" – means the first purchase ever made by the Shared Customer whether it is the 7 Tools Package or any Direct Service.

"Payment" – means the combined total amount of monies to be paid to the Promoter for their sharing efforts.

"Site" – means TapTheLINK.com and other TapTheLINK online media including, social and electronic brochures.

 

Payments to Promoter

In respect to a 7 Tools Package purchased by a Shared Customer, the Promoter will receive from TapTheLINK.com:

A) A Flat Rate sharing payment of $500 (U.S. Dollars), and

B) in the event that during the First Order placed by the Shared Customer, additional purchases of other Direct Services provided by TapTheLINK were made, the Promoter will receive an added 5% Bonus.  

 

All Flat Rate and Bonus monies owed to the Promoter, hereafter referred in total as the "Payment", will be made under one of the two options stated below at the sole discretion of the Promoter:

Option 1)  

Promoter may choose to receive 50% of the Payment owed to Promoter immediately after the initial deposit paid by the Shared Customer has cleared the bank for release and the remaining 50% of Payment to be paid to Promoter upon receipt and clearing of the balance paid by the Shared Customer when the project is completed.

    -OR-

Option 2)

Rep may choose to receive 80% of the total Payment owed to Promoter for the entire order to be made up front immediately after the initial deposit paid by the Shared Customer has cleared the bank for release.  

 

Residual Bonuses

Upon qualification, a Bonus of 5% will paid to the Promoter for any Direct Services provided by TapTheLINK that is purchased and paid for by their Shared Customer.

Qualification for the Residual Bonus is as follows:

1) The Promoter must share-to-produce three Shared Customers that each purchase any Direct Service provided by TapTheLINK within 60 days of the receipt of their personalized eBrochure.  

a) The Shared Customers do not have to purchase a Direct Service within the 60-day time window for the Promoter to qualify, but all the Shared Customers must START their Request for Quote within the 60-day window and CLOSE for service within 120 days from the qualification commencement date.

b) The Residual Bonus program, for any and all Shared Customer's activities, will not commence until all three required Shared Customers contract and pay their deposit for their Direct Service.

2) To maintain Qualification and continue to Receive the Residual Bonus, Promoters must share and TapTheLINK subsequently close for the purchase of any Direct Service, at least one new Sharing Customer every 3 months from the date of the Promoter's Residual Bonus Qualification date, as indicated in the Residual Bonus Qualification Announcement emailed to the Promoter upon completion of their initial Qualification.

 

Sharing Support

TapTheLINK will provide Promoter with a LINK Guide containing operational information, other sales support items and access to the sharing Tool Shed on TapTheLINK.com for ongoing support materials.

 

Operations and Activities

TapTheLINK will copy the Promoter on pertinent emails, order forms placed by the Sharing Customer and payment communications submitted to and from the Sharing Customer.

 

The production and communication process is as follows (subject to change and modification as the project and situation requires):

The shared prospect taps an Inquiry and/or Request for Quote START button –> Promoter receives a real-time email notice of the inquiry –> TapTheLINK will email a proposal (Promoter copied in the email, again in real-time) –> TapTheLINK will exchange a few emails with the prospect (again, Promoter is copied)  until a final direction is agreed upon –> An invoice for a 50% deposit is submitted to the Shared Customer and when payment is received and released by the bank the project is started (Promoter is copied) –> After the production time and the 7 Tools Package is completed, a bill for the balance is submitted to the Shared Customer (Promoter is copied).

 

Promoter Terms of Conduct

(1) Promoter will be honest and fair in all of their dealings regarding TapTheLINK services and operations; (2) Promoter will not make any claims or any unauthorized representation regarding TapTheLINK or any TapTheLINK services (3) it is the Promoter's responsibility to comply with all laws, rules and regulations that apply to their area and business; (4) Rep understands that they are an independent contractor and are not an employee of TapTheLINK, but are only authorized to act as a referring agent to promote the sale of and to solicit orders for the sale of the TapTheLINK services; (5) Promoter will use promotional materials provided by TapTheLINK or materials approved by TapTheLINK; (6) this agreement may be terminated by either party at any time; and (7) in the event of a dispute between the Promoter and TapTheLINK, Promoter agrees that it will be settled through JAMS/Endispute arbitration under the laws of the State of California, in San Diego County, and that the winner of such dispute may recover all legal fees and costs expended in such dispute.

 

Collection of Information

At different occasions you may be asked for certain types of personally-identifiable information (e.g., your first and last name, mailing address, city, state, zip code, telephone number, email address, bank information in connection with automatic deposit, etc.). We hope you will provide us with this information. However, if you do not want to disclose your personally-identifiable information to us, please do not submit it. This does mean that in some cases we will not be able to provide you the service you have requested. We may also collect non-personally identifiable information from you when you visit the Site (e.g., your IP address, browser type, domain name, etc.). This information is collected and analyzed in the aggregate in order to improve the function and content of the Site.

 

Privacy Policy 
We use the information that is collected about you for a variety of purposes. In general, however, we foresee the following uses:
Website visitors
Information about you may be used to add you to our email subscription list, provide your name to TapTheLINK affiliates with your expressed interest in our services or business opportunities, analyze trends and statistics, enhance the operation of the Site, serve content and advertisements and send informational and promotional materials about TapTheLINK and other associated companies.

   Representatives
Information about Promoters will in addition be used to provide support service, confirm and fulfill your referred orders, and administer payments and possible problems and disputes with dispatchers and other service providers.

      CHOICE
We have existing business relationships and may develop other relationships in the future with business partners. In these instances, we may share or otherwise allow access to information that is collected about you that will enable our business partners to contact you regarding products and services that may be of interest to you.

   SECURITY 
We take reasonable steps to ensure that the personal information we collect about you remains accurate, timely and secure. Unfortunately, no data transmission over the Internet can be guaranteed to be 100% secure and while we strive to protect your personal information, we cannot guarantee or warrant its complete security. We shall not be responsible for harm that you or any person may suffer as a result of a breach of confidentiality in respect to your use of the Site or any information you transmit to the Site.

   DATA INTEGRITY
Personally-identifiable information will be kept in active files or systems as long as needed to meet the purposes for which it was collected or as required to perform the contractual relationship with us, with TapTheLINK and the commercial relationship with the customer. We will make reasonable efforts to ensure that the information is accurate and complete.

   ACCESS OR CORRECTIONS TO YOUR INFORMATION 
If you identify any inaccuracy in your personal information, or if you need to make a change or would like to verify such information, please contact us so that we may update your information in our records. Our contact information is set forth below. We will use commercially reasonable efforts to accommodate all such requests.

   COMPLAINTS
We take privacy concerns seriously. If you believe that we have not complied with this Privacy Policy, you may write to the email address below. Please describe in as much detail as possible the ways in which you believe that our Privacy Policy has not been complied with. We will investigate your complaint promptly.      


TapTheLINK reserves the right to change this Privacy Policy at any time. Any changes to this Policy will be effective immediately upon notice, which may be provided to you via e-mail or by posting the latest version on our Site. Your subsequent use of the Site be deemed acceptance of such changes. Be sure to review this Privacy Policy periodically to ensure familiarity with its most current version. You can easily confirm whether any revisions have been posted since your last visit by checking the date on which the Policy was last revised, which is set forth at the bottom of this Policy. By using the Site, your Promotional Materials or receive any Fees or Bonuses following the posting of changes to this Privacy Policy, you agree to all such changes.

 

Agreement Terms

This Promoter Agreement will commence upon the delivery of the email containing the Promoter's personalized eBrochure or the Promoter's delivery of any promotional materials to the general marketplace.
